Terms of Service

1. Acceptance of Terms

By accessing and using Downtown Escape's services, including our escape room facilities located at 130 Spadina Avenue, Toronto, ON M5V 2L4, Canada, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and others who access or use our services.

2. Description of Services

Downtown Escape provides immersive escape room experiences with creative storylines and challenging puzzles. Our services include themed escape rooms, team-building activities, workshops, and related entertainment services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

3. Age Requirements and Supervision

Participants must be at least 10 years old to participate in our escape room experiences. Children under 16 must be accompanied by at least one adult (18 years or older) at all times during the experience. Adults are responsible for the conduct and safety of any minors in their group. We reserve the right to refuse service to unaccompanied minors or groups that do not meet our supervision requirements.

4. Booking and Payment Terms

Full payment is required at the time of booking unless otherwise arranged. We accept major credit cards and cash payments. Prices are subject to change without notice, but confirmed bookings will honor the originally quoted price.

5. Cancellation and Refund Policy

Cancellations made at least 24 hours before the scheduled experience will receive a full refund. Cancellations made less than 24 hours in advance will incur a 50% cancellation fee. No-shows will not be refunded. In cases of extreme weather or facility emergencies, we will work with customers to reschedule or provide appropriate refunds at our discretion.

6. Health and Safety Requirements

Participants must be in reasonable physical health to participate in escape room activities. Our experiences may involve physical activity, low-light conditions, confined spaces, and sudden sounds or visual effects. Participants with heart conditions, claustrophobia, epilepsy, or other medical conditions that could be aggravated by these elements should not participate. Pregnant women should consult with their healthcare provider before participating.

7. Code of Conduct

All participants must behave respectfully towards staff, other customers, and facility property. Prohibited behaviors include but are not limited to: use of excessive force on props or equipment, inappropriate language or behavior, consumption of alcohol or illegal substances on premises, and failure to follow safety instructions. We reserve the right to terminate any experience immediately for violations of our code of conduct without refund.

8. Liability and Assumption of Risk

Participation in escape room activities involves inherent risks. By participating, you acknowledge and assume these risks and agree to hold Downtown Escape, its owners, employees, and agents harmless from any claims, damages, or injuries that may result from your participation, except in cases of gross negligence or willful misconduct on our part.

9. Photography and Recording

Downtown Escape may photograph or record participants for promotional, training, or security purposes. By participating in our services, you consent to such recording and the use of your likeness in our marketing materials. Participants are prohibited from photographing, recording, or livestreaming their escape room experience without express written permission.

10. Intellectual Property

All escape room designs, puzzles, storylines, and related intellectual property are owned by Downtown Escape. Participants may not reproduce, distribute, or create derivative works based on our proprietary content. Any feedback or suggestions provided by participants may be used by Downtown Escape without compensation or attribution.

11. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy. We are committed to protecting your privacy and complying with applicable data protection laws.

12. Corporate and Group Bookings

Special terms may apply to corporate events, team-building sessions, and large group bookings. These will be outlined in separate agreements or booking confirmations. Corporate clients are responsible for ensuring all participants in their group comply with these terms of service.

13. Force Majeure

Downtown Escape will not be liable for any failure or delay in performance under these terms that is due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government regulations, labor disputes, or technical failures.

14. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

15. Governing Law and Dispute Resolution

These terms shall be governed by the laws of Ontario, Canada. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Toronto, Ontario, or in the courts of competent jurisdiction in Toronto if arbitration is not feasible.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
